Every claim of discrimination starts with a filing at the Massachusetts Commission Against Discrimination (MCAD). MCAD is an administrative state commission with its own set of regulations and procedures.
An investigation will begin at MCAD when the complainant files a charge outlining the discrimination. Customarily, the charge must be filed with MCAD within 300 days of the alleged act, unless it’s a continuing act. The respondent then has 21 days to file a response. The complainant has the right to rebut the response.
MCAD will hold an investigative conference before issuing a finding. If MCAD finds probable cause, then the matter moves to a public hearing. After the public hearing, MCAD has the power to award damages to the complainant.
